• Any ads found in violation will be removed, and Tread Traders reserves the right to report such activity to authorities.

Prohibited Items and Content

The following are prohibited on the Site:

• Counterfeit, stolen, or illegal items.
• Content that is inappropriate, offensive, defamatory, or violates local, provincial, or federal laws.

Sellers are solely responsible for ensuring their listings comply with all Canadian regulations, including laws governing the resale of automotive parts.

Ad Placement and Duration

• Ads must be placed in the appropriate category and adhere to Site guidelines. Misleading placements may result in removal.
• Ads remain active for [insert specific duration, e.g., 30 days] unless:

• Removed by the Seller.
• Flagged for violating these Terms.
• Renewed under the Site’s policies.

Pricing

• All prices must be clearly displayed and reflect the actual selling price, as required by the Competition Act.

• Misrepresentation of pricing will result in the removal of the ad.

Disclosure of Condition

Sellers must disclose all relevant details about the items, including:

• Repairs, damages, or wear patterns.
• Tread depth and other significant factors that may influence the Buyer’s decision.

Failure to disclose these details may result in removal of the ad and possible account suspension.

Photos

• Images uploaded must accurately represent the product being sold.
• Stock images are discouraged unless accompanied by actual product photos.
• Misleading photos are grounds for removal.

Communication and Privacy

• Users must communicate respectfully and in good faith.
• Personal information shared during transactions must comply with Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA).
• Tread Traders is not liable for the misuse of personal information shared between Users.

Sale of Goods

These Terms and Conditions govern the sale of goods available on our Site.

The following goods are available on our Site:

• Digital advertising packages;
• Digital advertising subscriptions; and
• Online advertising.

These Terms and Conditions apply to all the goods that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk.

We reserve the right to modify, reject, or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Subscriptions

Your subscription automatically renews, and you will be automatically billed until we receive notification that you want to cancel the subscription.

To cancel your subscription, please follow these steps: Users may cancel their subscription to Tread Traders at any time. Subscription cancellations are effective immediately upon confirmation unless otherwise stated in the specific terms of the plan. No refunds will be issued for unused days within the billing cycle after cancellation. Access to subscription benefits will continue until the end of the current billing period.

Payments

We accept the following payment methods on our Site:

• Credit Card;
• Apple Pay; and
• Google Pay

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or Terms and Conditions, we reserve the right to cancel of reverse your transaction.

Liability and Disclaimer

• Facilitator Only: Tread Traders Inc. acts solely as a facilitator and is not involved in transactions between Buyers and Sellers.
• No Guarantees: We do not verify or endorse the quality, safety, or legality of items listed.
• Assumption of Risk: Transactions are conducted at the Users’ own risk.

To the fullest extent permitted by Canadian law:

• Tread Traders is not liable for damages, including but not limited to lost profits, personal injury, or property damage arising from use of the Site.
• Tread Traders is not responsible for disputes, including non-delivery, defective products, or payment issues.

Compliance with Canadian Laws

All transactions on the Site must comply with Canadian laws, including:

• The Consumer Protection Act (for applicable provinces).
• Taxation requirements (e.g., GST/HST).
• Privacy laws such as PIPEDA.

Sellers are solely responsible for adhering to these laws.

Fraud and Misrepresentation

• Fraudulent activity, false advertising, or attempts to mislead Buyers will result in immediate removal of the ad and potential account suspension.
• Tread Traders reserves the right to report such activity to law enforcement.

Right to Modify or Remove Ads

The Site reserves the right to:

• Edit, modify, or remove ads that violate these Terms or are flagged for review.
• Suspend or terminate accounts at its discretion.

No refunds will be issued for removed ads unless explicitly stated.

Indemnity

Users agree to indemnify and hold harmless Tread Traders Inc., its affiliates, and its operators from any claims, damages, or expenses (including legal fees) arising from:

• Their use of the Site.
• Violations of these Terms.
• Breaches of applicable Canadian laws.

Dispute Resolution

• Buyers and Sellers are encouraged to resolve disputes directly.
• Tread Traders is not obligated to mediate but may assist at its discretion.
• Disputes involving Tread Traders will be governed by the laws of the Province of Alberta, Canada.

Refunds and Fees

• All ad listing fees, subscription charges, and promotional fees are non-refundable, except in circumstances where the Site explicitly agrees to provide a refund.
• Sellers who violate these Terms are not eligible for refunds for ads removed due to non-compliance.
• Additional charges for premium features or ad extensions must be paid in advance and are also non-refundable.

Consumer Protection Law

Where the Consumer Protection Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under the legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislations. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

We are not responsible for the content, policies, or practices of any third party website or service linked to on our Site. Governing Law and Jurisdiction

This agreement shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, any disputes shall be directed to Tread Traders Inc..

• Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Edmonton, Alberta.

Limitation of Liability

Tread Traders Inc. and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Severability Clause

If at any time any of the provisions of set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will no be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Force Majeure

Tread Traders shall not be held liable for any delay or failure to fulfill its obligations under these Terms due to events beyond its reasonable control, including but not limited to:

• Acts of God, natural disasters, or severe weather conditions.
• Government actions or regulations.
• Internet or communication failures.

Changes to Terms

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site. Continued use of the Site constitutes acceptance of the updated Terms.
